TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP"). By accessing or using our websites, platforms or services, you agree to be bound by these Terms.

For Advertisers, these Terms also include the Listing Agreement (incorporated by reference). If inconsistent regarding listing specifics, the Listing Agreement prevails.

These Terms apply to all HALP platforms including www.halp.com.au, www.boutiquedevelopments.com.au, associated mobile apps and related websites within our network.

By accessing our services you acknowledge you have read and understood these Terms, agree to be bound by them and our Privacy Policy, represent you are at least 18, and have authority to enter into this agreement.

We may modify these Terms at any time. Material changes are notified via the Last Updated date, email to registered users and prominent display on our sites. Continued use constitutes acceptance.

2. Description of Services

HALP operates specialised property discovery and business directory platforms — house & land listings, off-the-plan information, development details, boutique and luxury showcases, school zone maps, property calculators, mortgage broker connections and market insights, plus a business directory with freemium listings and premium visibility.

HALP is an information and advertising platform. We are not a real estate agent, developer, builder or financial advisor. Property listing inquiries go directly to the listing agent, developer or builder — HALP does not store or process these. Contact Us / Join Us / Advertise With Us form submissions are collected and managed by HALP per our Privacy Policy.

Services are provided "as is" and "as available". We may modify, suspend or discontinue services at any time. Our platform relies on AWS, Stripe, Pipedrive, ActiveCampaign, Google Workspace and Zapier; providers may change over time.

3. User Accounts and Registration

To register you must provide accurate information, be at least 18, maintain confidentiality of your credentials, hold one account per person, and provide a valid ABN/ACN for business accounts. You are responsible for all activity under your account. We may suspend or terminate accounts for breach, false information, fraud, non-payment or extended inactivity. You may terminate your account by contacting support@halp.com.au.

4. User Conduct and Prohibited Activities

You agree to comply with laws, use services lawfully, provide accurate information, respect IP rights, and act in good faith. You must not use bots or scrapers without authorisation, interfere with the platform, attempt unauthorised access, reverse engineer, post false or misleading information, upload malware, spam or phish, impersonate others, violate laws, harass or discriminate, or misuse the platform commercially.

Violations may result in suspension or termination, content removal, legal action, or reporting to law enforcement.

5. Property Listings and Information

Property listings are provided and owned by developers, builders, agents, project marketing companies and third-party data providers. HALP does not own, control or verify all listings.

Property information may change without notice; prices, availability, specifications, images, land sizes and school zone information are provided for reference only. Always verify critical information directly with the property provider.

School zone data is sourced from government and third-party providers and provided for research only. Always verify catchments with the education department and individual schools. Enrolment is not guaranteed.

6. Business Directory Listings

To advertise you must hold a valid ABN/ACN, be a legitimate operating business, comply with law, provide accurate information and hold necessary licenses. Listings must accurately describe your services, use current contact information and your own name and logo, and comply with Australian Consumer Law.

Free listings provide basic directory presence; premium subscriptions provide enhanced visibility, require payment, auto-renew unless cancelled and are subject to separate subscription terms.

You must respond to inquiries promptly and professionally, comply with privacy laws, and honor representations. We may remove or suspend listings for breach, credible complaints, non-payment, lack of license or prohibited content.

7. Payment Terms (Advertiser Subscriptions)

Pricing is as displayed on our website, at checkout, or in the applicable Listing Agreement, subject to 30 days notice for changes. Prices are in AUD, exclusive of GST unless stated. Payments are processed via Stripe (PCI-DSS Level 1). Subscriptions auto-renew; you may cancel any time before your next billing date. No partial refunds for unused time; pro-rata refunds for technical issues preventing service access, processed within 14 business days. Non-payment may result in suspension, listing removal and collection.

8. Intellectual Property Rights

All content and materials are owned by or licensed to HALP, including logos and trademarks ("HALP", "House And Land Packages", "Boutique Developments"), designs, code, data compilations and school zone aggregations.

We grant you a limited, non-exclusive, non-transferable, revocable licence for personal, non-commercial use of the platforms. You may not reproduce, distribute, modify, create derivative works, or use content commercially without permission.

You retain ownership of user-generated content but grant us a worldwide, royalty-free licence to use, reproduce, modify and display it. Copyright infringement claims: legal@halp.com.au.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax or real estate advice. Our calculators provide estimates only. Always consult qualified professionals.

We facilitate connections but do not control third parties and are not responsible for their actions. Information may contain errors or be outdated. We do not guarantee continuous availability, error-free operation or absence of viruses. Our platform relies on third-party services (AWS, Stripe) — we are not responsible for their failures.

10. Limitation of Liability

To the maximum extent permitted by law, HALP is not liable for direct, indirect, consequential, incidental, special or punitive damages arising from your use of services, third-party conduct, unauthorised account access, service interruptions or property transactions.

Where liability cannot be excluded, our total liability is limited to $100 AUD for free services, or (for paid services) the lesser of $1,000 AUD or amounts you paid in the prior 12 months.

Nothing excludes rights under the Australian Consumer Law. Where consumer guarantees apply, our liability is limited to re-supplying the services or paying the cost of re-supply.

You agree to indemnify HALP against claims, damages, losses and expenses arising from your breach of these Terms, violation of law or third-party rights, use of services, submitted content or interactions with others.

11. Dispute Resolution

Before legal proceedings, contact legal@halp.com.au and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales; exclusive jurisdiction is NSW courts. Optional arbitration under ADRA rules in Sydney is available. Class actions are waived to the extent permitted by law. Nothing prevents seeking injunctive relief in court.

12. General Provisions

These Terms with our Privacy Policy constitute the entire agreement. If any provision is invalid, the remainder continues in force. Failure to enforce is not a waiver. You may not assign without our written consent; we may assign to affiliates or in a merger, acquisition or asset sale. 13. Special Terms for Specific Services

Mortgage calculators provide estimates only, not pre-approvals. School zone data is aggregated from public databases and provided as-is — always verify with the education department and school. Property alerts are sent based on your saved criteria; you can modify or cancel any time. When we connect you with mortgage brokers we may receive a referral fee — brokers are independent third parties, must be licensed and comply with responsible lending laws.
